MARIJUANA "WEED" DEFENSE ATTORNEY

Although the rest of the United States is legalizing marijuana, Texas still has serious penalties for the possession of marijuana that can impact you, your career, and your family.


In Texas, possession of marijuana—also referred to as marihuana, weed, or pot—carries steep penalties depending on the quantity. Under Section 481.121 of the Controlled Substances Act, a person can be charged with possession of marijuana if the person knowingly or intentionally possesses a useable quantity of marijuana. 

Pro tip: clean your car. If your car smells like weed and you are pulled over, you will be searched!

Penalties for Possession of Marijuana

2 ounces or less of Marijuana

If you are caught with two ounces or less of Marijuana, you can be charged with a Class B Misdemeanor. Class B misdemeanors carry a penalty of confinement in county jail for up to 180 days and/or a $4,000 fine.

2 to 4 ounces of Marijuana

If you are caught with marijuana in an amount between two to four ounces, you can be charged with a Class A misdemeanor. Class A misdemeanors carry a penalty of confinement in county jail for up to 360 days and/or a $4,000 fine.

4 ounces to 5 pounds of marijuana

If you are caught with marijuana in an amount of four ounces to five pounds, you can be charged with a state jail felony. A state jail felony conviction carries a penalty between 180 days and up to two years in state jail and/or up to a $10,000 fine. 

5 to 50 pounds of marijuana

If you are caught with marijuana in an amount of five to fifty pounds of marijuana, you can be charged with a third-degree felony. A third-degree felony carries a penalty between two to ten years and/or up to a $10,000 fine. 

50 to 2,000 pounds of marijuana

If you are caught with marijuana in an amount of fifty pounds to two thousand pounds, you can be charged with a second-degree felony. A second-degree felony carries a penalty between two to twenty years in prison and/or up to a $10,000 fine. 

over 2,000 pounds of marijuana

If you are caught with more than 2,000 pounds of marijuana, you can be charged with a first-degree felony. A first-degree felony carries a penalty of life or 5 to 99 years in prison and a fine up to $50,000.
